1. Acceptance of Terms

By downloading, installing, or using the Habits application ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Habits is a productivity application for iOS that provides:

• A Pomodoro technique timer with customizable focus and break durations
• Background alarm functionality powered by AlarmKit (iOS 26+)
• Live Activity and Dynamic Island integration for at-a-glance timer status
• A daily habit tracker with completion tracking and calendar visualization
• Session history logging for completed and interrupted Habits sessions

The App is designed to function entirely offline and does not require an internet connection or user account.

3. Eligibility

The App is available to users of all ages. No account creation or personal information is required to use the App.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to the Apple Media Services Terms and Conditions. This license does not allow you to:

• Modify, reverse-engineer, decompile, or disassemble the App
• Distribute, sublicense, lease, or rent the App to third parties
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices or labels on the App

5. Intellectual Property

The Pomodoro Technique® was created by Francesco Cirillo. Habits is an independent implementation and is not affiliated with, endorsed by, or sponsored by Francesco Cirillo or the Pomodoro Technique® trademark holders.

6. User Data & Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• The App does not collect, transmit, or share any personal data
• All data (session history, habits, settings) is stored locally on your device
• Deleting the App removes all associated data permanently

7. AlarmKit & System Permissions

The Habits app uses AlarmKit (iOS 26+) to schedule alarms that fire even when the App is not running. By granting alarm permission:

• You acknowledge that alarms will sound even in Silent Mode and through Focus filters
• You can revoke alarm permission at any time through iOS Settings
• The App also requests notification permission for session phase transition alerts
• You can manage notification preferences in iOS Settings → Notifications → Habits

8. Availability & Updates

• The App requires iOS 26 or later
• We may release updates to improve functionality, fix bugs, or comply with platform requirements
• We reserve the right to modify, suspend, or discontinue the App at any time without prior notice
• We are not obligated to provide maintenance, support, or updates

9. In-App Purchases & Subscriptions

If the App offers in-app purchases or subscriptions:

• All purchases are processed through Apple's App Store and are subject to Apple's payment terms
• Prices are displayed in your local currency before purchase confirmation
• Refund requests must be directed to Apple, as we do not process payments directly
• Subscription terms, including auto-renewal and cancellation, are governed by Apple's subscription policies

10. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

We do not guarantee that alarms will fire under all device conditions, or that the App will be compatible with all future iOS versions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities. Our total liability shall not exceed the amount you paid for the App (if any).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use or misuse of the App, or your violation of these Terms or any applicable laws.

13. Third-Party Services

The App does not integrate with third-party services. However, the App operates within Apple's iOS ecosystem and is subject to Apple's Media Services Terms and Conditions and Apple's Privacy Policy.

14. Termination

We may terminate or suspend your access to the App at any time without prior notice. You may terminate your use of the App at any time by deleting it from your device.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
